وفيما يتعلق بالادعاء بأن وزير الخارجية الإسباني لم يطع أمراً قضائياً (Mandato Judicial)، أشارت الدولة الطرف إلى أن مقدم الشكوى رفع هذا الادعاء أمام Tribunal Supremo، التي رفضت الطلب على أساس أنه لا يوجد، بموجب القانون الإسباني حسب تفسير هذه المحكمة، مثل هذا الأمر الذي يتعين على الوزير أن يطيعه
