APPLICATION principally for the annulment of the Commission decision notified by memorandum No 69915 of 21 December 1990 in which it informed Oleificio Borelli SpA that it could not grant its application for aid from the European Agricultural Guidance and Guarantee Fund, Guidance Section, for the 1990 financial year under Council Regulation (EEC) No 355/77 of 15 February 1977 on common measures to improve the conditions under which agricultural products are processed and marketed (OJ 1977 L 51, p. 1), and also for the annulment of all the procedural measures leading up to that decision or, in the alternative, for an order that the Commission and/or the region of Liguria make good the damage caused to the applicant,

Talan avser i första hand ogiltigförklaring av kommissionens beslut enligt skrivelse nr 69915 av den 21 december 1990, genom vilken kommissionen underrättade Oleificio Borelli SpA om att den inte kunde bifalla bolagets ansökan om stöd från utvecklingssektionen vid Europeiska utvecklings- och garantifonden för jordbruket för räkenskapsåret 1990 enligt rådets förordning (EEG) nr 355/77 av den 15 februari 1977 om gemensamma åtgärder för att förbättra villkoren för bearbetning och saluföring av jordbruksprodukter (EGT nr L 51. s. 1, fransk version; vid översättningen fanns ingen svensk version att tillgå), vidare yrkas ogiltigförklaring av alla de handlingar som lett till det beslutet. I andra hand yrkas att kommissionen och/eller regionen Ligurien skall åläggas ersätta sökanden för den skada som tillfogats bolaget.
