Blood Tribe Department of Health, 2008 SCC 44 (“Blood Tribe”) – after reviewing that decision, the Board concluded that, as a quasi-judicial tribunal, it had the power to determine whether a solicitor-client privilege applied to a particular document – the Board ordered the respondents to produce an affidavit on the nature of the document and on the grounds for claiming solicitor-client privilege.

En réponse à la demande du plaignant visant à obtenir un document qui serait protégé par le secret professionnel de l’avocat, les défendeurs ont fait valoir que la Commission ne possédait pas le pouvoir de déterminer que le document était effectivement assujetti au secret invoqué – l’argument des défendeurs reposait sur la décision rendue par la Cour suprême du Canada dans Canada (Commissaire à la protection de la vie privée) c. Blood Tribe Department of Health, 2008 CSC 44 («Blood Tribe») – après examen de cette décision, la Commission a conclu qu’en sa qualité de tribunal quasi judiciaire, elle possédait le pouvoir de décider si le secret professionnel de l’avocat s’appliquait à un document en particulier – la Commission a ordonné aux défendeurs de produire un affidavit portant sur la nature du document et sur les motifs pour lesquels le secret professionnel de l’avocat est invoqué.
