On entend par confiscation selon une procédure administrative le transfert d’un bien à l’État en toute propriété sans contrepartie à la suite d’une décision d’un tribunal (art. 29 du Code des infractions administratives), et par saisie contre paiement la saisie forcée, effectuée à la suite d’une décision d’un tribunal, avec vente ultérieure et transfert de la somme ainsi obtenue au propriétaire, déduction faite des frais encourus pour la vente (art. 29 du Code des infractions administratives).
