If the child is 16 or over at the moment of entering into a family-law relationship with both parents, he/she declares to the registrar of births, deaths and marriages - or in the case of a judicial declaration of paternity, to the court - which surname he/she wishes to take.

Si el niño ha cumplido los 16 años en el momento de entrar a formar parte de la relación familiar-legal con ambos progenitores, el niño consignará en el registro de nacimientos, fallecimientos y matrimonios -o en el caso de una declaración judicial de paternidad, ante el juez- el apellido que desee llevar.

Si l’enfant est âgé de 16 ans ou plus au moment où il noue un lien familial légal avec ses deux parents, il déclare à l’officier d’état civil − ou au juge, dans le cas d’une déclaration de paternité établie par le tribunal − le nom qu’il souhaite prendre.
