وخلصت المحكمة عند موافقتها على ذلك الطلب إلى أن الجزء المتعلق بالعربون من قرار التحكيم منفصل عن باقي أجزاء قرار التحكيم، بالاستناد إلى القانون المحلي المقابل للمادتين 34 (2) (أ) ‘3‘ و36 (1) (أ) ‘3‘ من القانون النموذجي للتحكيم.

In granting the application, the court found that the arbitration award relating to the deposit was severable from the remainder of the award, on the ground of domestic law corresponding to articles 34 (2)(a)(iii) and 36 (1)(a)(iii) MAL.

El tribunal accedió a la solicitud, al dictaminar que la decisión del laudo arbitral relativa al depósito se podía separar del resto del laudo, sobre la base de disposiciones del derecho interno correspondientes a los artículos 34 2) a) iii) y 36 1) a) iii) de la LMA.
