Cour d'appel fandt, da den kontrollerede nødvendigheden af en sådan lovgivning i forhold til de interesser, der skulle beskyttes, ud fra Domstolens sondring i ovennævnte Parodi-dom (præmis 29) efter arten af den pågældende bankvirksomhed og den risiko, modtageren af tjenesteydelsen løb, at den franske lovgivning gik ud over det objektivt nødvendige for at beskytte de interesser, som lovgivningen skulle værne, og erklærede som følge heraf, at den nævnte lovgivning var uforenelig med traktaten.

Die Cour d'appel widmete sich dann der Prüfung der Unerlässlichkeit derartiger Rechtsvorschriften im Hinblick auf die zu schützenden Interessen und griff zu diesem Zweck die Unterscheidung auf, die der Gerichtshof in Randnummer 29 des vorgenannten Urteils Parodi zwischen der Art der betreffenden Banktätigkeit und dem Risiko, das für den Dienstleistungsempfänger besteht, getroffen hatte, und kam zu der Auffassung, dass die französischen Rechtsvorschriften über das für den Schutz der Interessen, deren Schutz sie bezweckten, objektiv Notwendige hinausgingen, und erklärte infolgedessen, dass die besagten Rechtsvorschriften mit dem Vertrag unvereinbar seien.

The Court of Appeal then considered the question whether such legislation was necessary in the light of the interests to be protected. In so doing, it took over the distinction which the Court of Justice had drawn in paragraph 29 of the Parodi judgment with regard to the nature of the banking activity in question and the risk incurred by the person for whom the service was intended. The Court took the view that the French law went beyond what was objectively necessary to protect the interests it sought to protect and accordingly declared it incompatible with the Treaty.

El Tribunal de Apelación al controlar el carácter indispensable de semejante normativa respecto a los intereses por proteger y haciéndose eco, para ello, de la distinción que había hecho el Tribunal de Justicia en el apartado 29 de la sentencia Parodi, antes citada, según la naturaleza de la actividad bancaria en cuestión y del riesgo incurrido por el destinatario del servicio, consideró que la legislación francesa iba más allá de lo objetivamente necesario para proteger los intereses que pretendía proteger y declaró, en consecuencia, que dicha legislación era incompatible con el Tratado.

La Cour d'appel se livrant alors au contrôle du caractère indispensable d'une telle législation au regard des intérêts à protéger et reprenant, pour ce faire, la distinction qu'avait faite la Cour de justice au point 29 de l'arrêt Parodi, précité, selon la nature de l'activité bancaire en cause et du risque encouru par le destinataire du service, a estimé que la législation française allait au-delà de ce qui était objectivement nécessaire pour protéger les intérêts qu'elle avait pour but de protéger et a déclaré, en conséquence, que ladite législation est incompatible avec le Traité.

La Cour d'appel, nell'esaminare se tale normativa fosse indispensabile ai fini della tutela degli interessi in questione e riprendendo a tal fine la distinzione - proposta dalla Corte di giustizia al punto 29 della sentenza Parod - basata sulla natura dell'attività bancaria di cui si tratta e sul rischio che grava sul destinatario del servizio, ha ritenuto che la legislazione francese andasse al di là di quanto è oggettivamente necessario per tutelare gli interessi che essa ha l'obbligo di proteggere ed ha conseguentemente dichiarato che tale legislazione non è compatibile con il trattato.

A Cour d'appel, ao analisar o carácter indispensável de uma legislação deste tipo dados os interesses a proteger e retomando, para o efeito, a distinção feita pelo Tribunal de Justiça no ponto 29 do acórdão Parodi, em função da natureza da actividade bancária em causa e dos riscos corridos pelo destinatário dos serviços, considerou que a legislação francesa vai além do objectivamente necessário para proteger os interesses que pretendia proteger e declarou a referida legislação incompatível com o Tratado.
