تقع على عاتق السلطة المسؤولية عن المقدار الفعلي لأي ضرر يلحق بالمتعاقد ويكون ناشئا عن أفعال غير مشروعة ارتكبتها في ممارستها لصلاحيتها ووظائفها، بما في ذلك الانتهاكات الواردة في الفقرة ٢ من المادة ١٦٨ من الاتفاقية، مع مراعاة أي فعل أو امتناع يكون قد أسهم به المتعاقد وموظفوه وعملاؤه والمتعاقدون معه من الباطن وجميع من يعملون لحسابه أو ينوبون عنه في إدارة العمليات التي يضطلع بها بموجب هذا العقد.

The Authority shall be liable for the actual amount of any damage to the Contractor arising out of its wrongful acts in the exercise of its powers and functions, including violations under article 168, paragraph 2, of the Convention, account being taken of contributory acts or omissions by the Contractor, its employees, agents and subcontractors, and all persons engaged in working or acting for them in the conduct of its operations under this contract.

La Autoridad será responsable del monto efectivo de los daños y perjuicios causados al contratista como resultado de sus actos ilícitos en el ejercicio de sus facultades y funciones, con inclusión de las violaciones previstas en el párrafo 2 del artículo 168 de la Convención, y teniendo debidamente en cuenta los actos u omisiones del contratista, los empleados, agentes y subcontratistas y las personas que trabajan para ellos o actuasen en su nombre en la realización de sus operaciones con arreglo al presente contrato que hayan contribuido a ellos.

Орган несет ответственность за любой фактический ущерб Контрактору, причиненный в результате его неправомерных действий при исполнении им своих полномочий и функций, включая нарушения, предусмотренные пунктом 2 статьи 168 Конвенции; при этом учитываются способствовавшие причинению такого ущерба действия или бездействие Контрактора или его работников, агентов и субподрядчиков, а также всех лиц, выполняющих для них работы или действующих от их имени при осуществлении Контрактором деятельности по настоящему контракту.
