ويدعي صاحب البلاغ أنه كان ينبغي تعيينه من جانب جامعة مودينا وريجيو إيميليا بموجب الفقرة 2 من المادة 16 من المرسوم الرئاسي رقم 487/1994، المشار إليها أيضاً في ديباجة إعلان الامتحان التنافسي([footnoteRef:6])، وفي ضوء ما جاء أعلاه، يرى صاحب البلاغ أن المرسوم رقم 595 المؤرخ 22 أيلول/سبتمبر 2006، الذي اعتمد بموجبه المدير الإداري في جامعة مودينا وريجيو إيميليا نتائج المسابقة العامة التي شارك صاحب البلاغ فيها في عام 2006، لم يعترف بحق صاحب البلاغ في أن يقع عليه الاختيار بموجب الفقرة 2 من المادة 7 من القانون 68/1999، مما يشكل انتهاكاً لحقوقه بموجب المادة 27 من الاتفاقية.

The author argues that article 16, paragraph 2, of Presidential Decree No. 487/1994, which was also included in the preamble of the competitive examination, provides that he should have been recruited by the University of Modena and Reggio Emilia.[footnoteRef:7] In the light thereof, the author considers that Decree No. 595 of 22 September 2006, through which the Administrative Director of the University of Modena and Reggio Emilia approved the results of the public competition in which the author had taken part in 2006, failed to recognize the author’s right to be selected in application of article 7, paragraph 2, of Law No. 68/1999, thereby violating his rights under article 27 of the Convention.

El autor afirma que el artículo 16, párrafo 2, del Decreto Presidencial No 487/1994, cuyo texto también aparecía en el preámbulo del concurso, dispone que debería haber sido contratado por la Universidad de Módena y Reggio Emilia[footnoteRef:6]. Por consiguiente, el autor considera que el Decreto No 595, de 22 de septiembre de 2006, mediante el que el Director Administrativo de la Universidad de Módena y Reggio Emilia aprobó los resultados del concurso público en el que había participado el autor en 2006, no reconoció su derecho a ser seleccionado en aplicación del artículo 7, párrafo 2, de la Ley No 68/1999, con lo que vulneró los derechos que lo asistían en virtud del artículo 27 de la Convención.
