Zum anderen hat er in einer Rechtssache entschieden, in der es um den geplanten Bau eines Touristikzentrums in einem Naturpark ging und in der der WWF und An Taisce (d. h. der National Trust for Ireland) dem betreffenden Mitgliedstaat vorwarfen, Richtlinien zum Umweltschutz mißachtet zu haben; es liegt daher auf der Hand, daß die Unregelmäßigkeit, die - mit den Worten des Gerichtshofes - "der Mitgliedstaat begangen hatte", die Art oder die Bedingungen der Durchführung nur einer einzigen spezifischen Maßnahme betraf und nichts mit unterbliebenen Kontrollen der in Artikel 23 Absatz 1 der Koordinierungsverordnung genannten Art zu tun hatte(15).

Αφετέρου, η απόφαση του Δικαστηρίου ανάγεται σε υπόθεση, αντικείμενο της οποίας ήταν σχέδιο κατασκευής τουριστικού κέντρου εντός φυσικού πάρκου, η υλοποίηση του οποίου συνιστούσε κατά τα WWF και An Taisce (ήτοι το National Trust for Ireland) παραβίαση εκ μέρους του ενδιαφερομένου κράτους μέλους των οδηγιών περί προστασίας του περιβάλλοντος. Επομένως, είναι προφανές ότι η προσαπτόμενη εν προκειμένω στο κράτος («το οικείο κράτος το οποίο υπέπεσε στην πλημμέλεια», κατά την έκφραση του Δικαστηρίου) παρατυπία είχε ως αντικείμενο τη φύση και τους όρους υλοποιήσεως ενός συγκεκριμένου μέτρου απλώς και μόνο και δεν αφορούσε αμέλειες στη διενέργεια ελέγχου της κατηγορίας εκείνων που προβλέπει το άρθρο 23, παράγραφος 1, του συντονιστικού κανονισμού (15).

On the other hand, it gave a judgment in a case concerning a project for the construction of a tourist centre in a national park, concerning which the WWF and An Taisce (i.e. the National Trust for Ireland) claimed that the Member State concerned failed to comply with directives to protect the environment; it is therefore clear that the irregularity which in that case was allegedly `committed by the State concerned' - these are the words of the Court - concerned the nature or conditions for implementation only of a specific measure, and had nothing to do with failure to carry out controls of the type described in Article 23(1) of the coordination regulation. Dall'altra, si pronunzia in un caso avente ad oggetto un progetto di costruzione di un centro turistico in un parco naturale, in merito al quale il WWF e An Taisce (cioè The National Trust for Ireland) contestavano allo Stato membro interessato il mancato rispetto di direttive a tutela dell'ambiente; è evidente, quindi, che l'irregolarità che nella specie si asseriva «commessa dallo Stato interessato» - sono parole della Corte - aveva ad oggetto la natura o le condizioni di attuazione soltanto di una specifica misura, e nulla aveva a che fare con mancati controlli del tipo di quelli previsti dall'art. 23, n. 1, del regolamento di coordinamento (15).

Por outro lado, o acórdão do Tribunal de Justiça diz respeito a um processo que tem por objecto a construção de um centro turístico num parque natural, no qual a WWF e a AN Taisce (isto é, National Trust for Irland) acusavam o Estado-Membro em causa de violar as directivas relativas à protecção do ambiente. Consequentemente, é evidente que a irregularidade imputada nesse processo ao Estado («cometida pelo Estado-Membro em causa», segundo as palavras do Tribunal de Justiça) tinha por objecto a natureza ou as condições de execução de uma medida específica apenas, e nada tinha a ver com falhas de controlo do tipo das previstas no artigo 23._, n._ 1, do regulamento de coordenação (15).
