For article 235 (Torture) to be extended to cover the actions of a broader category of persons, the article would have to be moved from the chapter entitled “Offences against justice” to another section of the Criminal Code, which would affect the extent and assessment of the risk to public safety and whether the article was consistent with the spirit of article 1 of the Convention against Torture.

L’élargissement du cercle des personnes dont les actes tombent sous le coup de l’article 235 relatif à la torture nécessitera le transfert dudit article du chapitre intitulé «Infractions en matière de justice» vers une autre partie du Code pénal, ce qui aura une incidence sur l’évaluation du degré de dangerosité de l’acte pour la société et sur la conformité dudit article avec le sens et l’esprit de l’article premier de la Convention contre la torture.

Расширение круга лиц, действия которых подпадают под статью 235 "Пытка", потребует переноса этой статьи из главы "Преступления против правосудия" в другую часть УК, что повлияет на оценку и значимость общественной опасности деяния и её соответствия смыслу и духу статьи 1 Конвенции против пыток.
