1 Με δικόγραφο που κατέθεσε στη γραμματεία του Δικαστηρίου στις 16 Οκτωβρίου 1987, η Επιτροπή των Ευρωπαϊκών Κοινοτήτων άσκησε, δυνάμει του άρθρου 169 της Συνθήκης ΕΟΚ, προσφυγή με την οποία ζητεί να αναγνωριστεί ότι η Ιταλική Δημοκρατία, παραλείποντας να γνωστοποιήσει τις νομοθετικές, κανονιστικές και διοικητικές διατάξεις, με τις οποίες θεωρεί ότι εκπλήρωσε τις υποχρεώσεις που υπέχει από την οδηγία 84/414 της Επιτροπής, της 18ης Ιουλίου 1984, για την προσαρμογή στην τεχνική πρόοδο της οδηγίας 74/764 σχετικά με τα ιατρικά θερμόμετρα υδραργύρου εξ υάλου με διάταξη σταθεροποιήσεως της μεγίστης θερμοκρασίας (ΕΕ L 228, σ. 25), ή μη λαμβάνοντας τα αναγκαία μέτρα για τη συμμόρφωσή της προς την οδηγία αυτή, παρέβη τις υποχρεώσεις που υπέχει από τη Συνθήκη ΕΟΚ.

1 By an application received at the Court Registry on 16 October 1987, the Commission of the European Communities brought an action under Article 169 of the EEC Treaty for a declaration that by failing to give notice of the laws, regulations and administrative provisions by which it considers that it has satisfied its obligations under Commission Directive 84/414/EEC of 18 July 1984 adapting to technical progress Directive 76/764/EEC on the approximation of the laws of the Member States relating to clinical mercury-in-glass maximum-reading thermometers ( Official Journal 1984, L 228, p . 25 ), or by failing to adopt the measures needed to comply with that directive, the Italian Republic has failed to fulfil its obligations under the EEC Treaty .

1 Mediante escrito presentado en la Secretaría del Tribunal de Justicia el 16 de octubre de 1987, la Comisión de las Comunidades Europeas interpuso un recurso, con arreglo al artículo 169 del Tratado CEE, que tiene por objeto que se declare que, al no comunicar las disposiciones legales, reglamentarias y administrativas mediante las cuales estima haber cumplido las obligaciones que le incumben en virtud de la Directiva 84/414/CEE de la Comisión, de 18 de julio de 1984 por la que se adapta al progreso ténico la Directiva 76/764/CEE, relativa a la aproximación de las legislaciones de los Estados miembros sobre los termómetros clínicos de mercurio, de vidrio y con dispositivos de máxima (DO L 228, p. 25; EE 13/16, p. 36) o al no adoptar las medidas necesarias para atenerse a ella, la República Italiana incumplió las obligaciones que le incumben en virtud del Tratado CEE.

1 Con atto depositato nella cancelleria della Corte il 16 ottobre 1987, la Commissione delle Comunità europee ha proposto, a norma dell' art . 169 del trattato CEE, un ricorso volto a far dichiarare che, omettendo di comunicare le disposizioni di legge, di regolamento ed amministrative con le quali ritiene di aver soddisfatto agli obblighi impostile dalla direttiva 84/414/CEE della Commissione, del 18 luglio 1984, per l' adeguamento al progresso tecnico della direttiva 76/764/CEE per il ravvicinamento delle legislazioni degli Stati membri relative ai termometri clinici di vetro al mercurio del tipo a massima ( GU L 228, pag . 25 ), o non adottando le misure necessarie per conformarvisi, la Repubblica italiana è venuta meno agli obblighi che le incombono in forza del trattato CEE .

1 Bij verzoekschrift, neergelegd ter griffie van het Hof op 16 oktober 1987, heeft de Commissie van de Europese Gemeenschappen krachtens artikel 169 EEG-Verdrag het Hof verzocht vast te stellen, dat de Italiaanse Republiek de krachtens het EEG-Verdrag op haar rustende verplichtingen niet is nagekomen, doordat zij heeft verzuimd mee te delen door middel van welke wettelijke en bestuursrechtelijke bepalingen zij meent te hebben voldaan aan de verplichtingen die op haar rusten krachtens richtlijn 84/414/EEG van de Commissie van 18 juli 1984 tot aanpassing aan de stand van de techniek van richtlijn 76/764/EEG van de Raad betreffende de onderlinge aanpassing van de wetgevingen der Lid-Staten inzake glazen koortsthermometers met kwikvulling en maximuminrichting ( PB 1984, L 228, blz . 25 ), dan wel heeft verzuimd de noodzakelijke maatregelen voor aanpassing aan die richtlijn te treffen .

1 Por requerimento entregue na Secretaria do Tribunal em 16 de Outubro de 1987, a Comissão das Comunidades Europeias intentou, nos termos do artigo 169.° do Tratado CEE, uma acção que tem por objecto obter a declaração de que, ao não comunicar as disposições legislativas, regulamentares e administrativas através das quais considera ter cumprido as obrigações que lhe incumbem por força da Directiva 84/414/CEE, da Comissão, de 18 de Julho de 1984, que adapta ao progresso técnico a Directiva 76/764/CEE, relativa à aproximação das legislações dos Estados-membros respeitantes aos termómetros clínicos de mercúrio, de vidro, com dispositivo de máximo (JO L 228, p. 25; EE 13 F16 p. 36), ou ao não adoptar as medidas necessárias para dar cumprimento a essa directiva, a República Italiana não cumpriu as obrigações que lhe incumbem por força do Tratado CEE.
