On 13 October 2016, the Dutch State Secretary for Economic Affairs, Mr Van Dam, announced in a Letter of Amendment to the Fertilisers Act as regards the introduction of a system of phosphate rights (with accompanying Letter of the Dutch Parliament) that in the Commission’s opinion the original draft law constituted unlawful state aid within the meaning of Article 107 TFEU and therefore needed to be amended, resulting in severe delays and continued uncertainty for Dutch livestock farmers — who are already affected by the dairy crisis and the Russian boycott — partly in view of a subsequent request by the Netherlands for a derogation under Directive 91/676/EEC after 2017.

Op 13 oktober 2016 deelde de Nederlandse staatssecretaris van Economische Zaken Van Dam in de Nota van wijziging bij het voorstel van wet tot wijziging van de Meststoffenwet in verband met de invoering van een stelsel van fosfaatrechten en bijbehorende Kamerbrief mede dat het aanvankelijke wetsvoorstel, naar oordeel van de Commissie, ongeoorloofde staatssteun zou vormen in de zin van art. 107 VWEU en derhalve gewijzigd dient te worden, met grote vertraging en voortdurende onzekerheid voor — reeds door zuivelcrisis en Rusland-boycot getroffen — veehouderijen in Nederland, mede inzake een volgend Nederlands verzoek tot derogatie na 2017 op grond van Richtlijn 91/676/EEG, tot gevolg.
