In particular, the courts of the State party arbitrarily dismissed their suit for medical negligence against the attending physician and the hospital, even though, during the proceedings, the courts themselves found that their mother’s written informed consent had not been obtained with respect to a portion of the medical procedure performed on 8 January 2008 (the percutaneous biopsy) and that the attending physician should have performed a second biopsy, which was subsequently performed in another hospital.

En particular, los tribunales del Estado parte desestimaron arbitrariamente su demanda por negligencia médica contra el médico tratante y el hospital, a pesar de que en el proceso los propios tribunales determinaron que no se había obtenido el consentimiento informado por escrito de su madre en relación con parte del acto médico realizado el 8 de enero de 2008 (la biopsia percutánea), y que el médico tratante debió practicar una segunda biopsia, que se realizó posteriormente en otro hospital.

В частности, суды государства-участника необоснованно отклонили исковое заявление авторов о медицинской халатности, поданное в отношении лечащего врача и руководства больницы, несмотря на то, что в ходе судебного разбирательства самими судами было установлено, что осознанного согласия их матери на одну из медицинских процедур, проведенную 8 января 2008 года (пункционную биопсию), в письменной форме получено не было и что лечащему врачу следовало провести повторную биопсию, которая была впоследствии произведена в другой больнице.
