كما تحثّ اللجنة الدولة الطرف على ضمان خلوّ ظروف الاحتجاز من الطابع العقابي وأن تتماشى مع الوضع الخاصّ لهؤلاء الأطفال باعتبارهم قُصّراً غير مشتبه فيهم أو مُدانين بارتكاب أي جريمة.

The Committee further urges the State party to ensure that detention conditions are of a non-punitive character and in line with the special status of such children as minors who are not suspected or convicted of any crime.

Asimismo, el Comité insta al Estado parte a velar por que las condiciones de detención no sean de carácter punitivo y estén en conformidad con la situación especial de esos niños como menores no sospechosos ni culpables de ningún delito.

Le Comité recommande en outre à l’État partie de faire en sorte que les conditions de détention ne revêtent pas un caractère punitif et tiennent compte de la situation particulière de ces enfants en tant que mineurs non soupçonnés ou reconnus coupables d’avoir commis une infraction quelconque.
