وفي القضية محل النظر، يستند قرار وزارة العدل بشأن إعادة طلب التسجيل الأول الذي قدمه صاحب البلاغ ‘دون النظر فيه‘، وهو القرار الذي أيدته المحكمة المشتركة بين المقاطعات ومحكمة مدينة طشقند، إلى عدم الامتثال المفترض للمعلومات الواردة في طلب منظمة ‘الديمقراطية والحقوق‘ لشرطين موضوعيين من الشروط التي ينص عليها القانون الداخلي للدولة الطرف وهما: (1) ألاّ تنخرط منظمة ‘الديمقراطية والحقوق‘ في أي نشاط من أنشطة حقوق الإنسان التي تزاولها أي هيئة رسمية؛ (2) وأن يكون لها حضور مادي في كل منطقة من مناطق أوزبكستان، إضافة إلى ‘العيوب‘ التقنية الموجودة في المعلومات الواردة في طلب التسجيل.

In the present case, the decision of the MoJ to return the author’s first registration application ‘without consideration’, as upheld by the Inter-District Court and the Tashkent City Court, is based on the perceived non-compliance of the application materials of ‘Democracy and Rights with two substantive requirements of the State party’s domestic law that: (1) ‘Democracy and Rights’ not engage in any human rights activities that any official body is engaged in, and (2) it be physically present in every region of Uzbekistan, as well as technical ‘defects’ in the association’s application materials.

En el presente caso, la decisión del Ministerio de Justicia de devolver la primera solicitud de inscripción del autor sin haberla examinado, decisión que fue reafirmada por el Tribunal Interdistrital y por el Tribunal Municipal de Tashkent, se basó en el presunto incumplimiento de dos requisitos sustantivos del derecho interno del Estado parte en la solicitud de "Democracia y Derechos", a saber: 1) que "Democracia y Derechos" no podía realizar ninguna actividad relacionada con los derechos humanos que ya estuviera realizando algún órgano oficial, y 2) que la organización debía estar físicamente presente en todas las regiones de Uzbekistán; también se tuvieron en cuenta los "defectos" técnicos detectados en la documentación de la solicitud.

Dans la présente affaire, la décision du Ministère de la justice de renvoyer la première demande d’enregistrement sans l’avoir examinée, qui a été confirmée par le tribunal interdistrict et le tribunal de la ville de Tachkent, repose sur la non-conformité supposée des documents joints à la demande de «Démocratie et Droits» avec deux conditions de fond prévues par la loi ouzbèke: 1) «Démocratie et Droits» ne doit pas se livrer à des activités relatives aux droits de l’homme qui relèvent de la compétence d’un organe officiel; et 2) elle doit être physiquement présente dans toutes les régions du pays; en outre, il y avait des «défauts» techniques dans les documents soumis par l’association.

В данном деле решение Минюста о возвращении первого заявления автора о регистрации "без рассмотрения", которое было подтверждено Межрайонным судом и Ташкентским городским судом, основано на усматриваемом несоблюдении в материалах заявления организации "Демократия и права" двух основных требований внутреннего права государства-участника о том, что: 1) организация "Демократия и права" не должна заниматься любой деятельностью в области прав человека, которой уже занимается какой-либо официальный орган, и 2) она должна физически присутствовать во всех районах Узбекистана, а также на наличии "недостатков" технического характера в поданных ассоциацией материалах заявления.
