Referring to article 1 (4) of the International Covenant on the Elimination of All Forms of Racial Discrimination and article 4 (1) of the Convention on the Elimination of All Forms of Discrimination against Women, which do contain explicit statements about the legitimacy of affirmative action measures, he points out that a contrary interpretation in the context of the Covenants would display an “extraordinary lack of congruence”.
