In the present Special Rapporteur's view, if there are to be punitive damages properly so-called, they should be called punitive damages, and they should be available- if at all- only in rare cases of manifest and egregious breach. It may be that the language of subparagraph (c) is equivocal in this respect, but the intention is clear
