Problemet i denne sag er, at mens invaliditetsydelsen efter belgisk ret normalt beregnes paa grundlag af den sidst oppebaarne loen, inden forsikringsbegivenheden indtraadte, har INAMI beregnet det teoretiske beloeb, ikke paa grundlag af Reichling' s sidste loenindkomst i Luxembourg, men paa grundlag af mindsteloennen i henhold til en belgisk kollektiv overenskomst.

Das sich in der vorliegenden Rechtssache stellende Problem liegt darin, daß nach den belgischen Rechtsvorschriften gewöhnlich das letzte Arbeitsentgelt des Berechtigten vor Eintritt seiner Arbeitsunfähigkeit für die Leistung bei Invalidität maßgeblich ist, während das INAMI zur Berechnung des theoretischen Betrages nicht das letzte Arbeitsentgelt des Herrn Reichling in Luxemburg, sondern den Mindestlohn gemäß einem belgischen Tarifvertrag heranzog.

Το πρόβλημα που έχει εν προκειμένω ανακύψει συνίσταται στο ζήτημα ότι, ενώ βάσει της βελγικής νομοθεσίας, μια παροχή αναπηρίας στηρίζεται καταρχήν στον τελευταίο μισθό που ελάμβανε ο αιτών πριν καταστεί ανίκανος προς εργασία, ο ΙΝΑΜΙ υπολόγισε το θεωρητικό ποσό όχι σε αναφορά με τον τελευταίο μισθό του Reichling στο Λουξεμβούργο αλλά με βάση την κατωτάτη αμοιβή που έχει ορισθεί με βελγική συλλογική σύμβαση εργασίας.

The problem arising in this case is that, while under the Belgian legislation invalidity benefit is normally based on the claimant' s final salary before he becomes unfit for work, the INAMI calculated the theoretical amount not by reference to Mr Reichling' s final salary in Luxembourg but on the basis of the minimum wage laid down by a Belgian collective agreement.

En este asunto se plantea el siguiente problema: mientras que, según la legislación belga, la prestación de invalidez se basa normalmente en el último salario del interesado antes de que le sobrevenga la incapacidad laboral, el INAMI calculó la cuantía teórica no referida al último salario en Luxemburgo, sino sobre la base del sueldo mínimo recogido en un convenio colectivo belga.

Le problème qui se pose en l' espèce réside en ce que, alors qu' en droit belge la prestation d' invalidité est normalement basée sur la dernière rémunération avant la réalisation du risque, l' INAMI a calculé le montant théorique non pas par référence à la dernière rémunération de M. Reichling au Luxembourg mais sur la base du salaire minimal prévu par une convention collective belge.

Il problema che sorge nella presente controversia consiste nel fatto che, mentre secondo la normativa belga la prestazione d' invalidità è normalmente basata sull' ultima retribuzione dell' interessato prima che egli divenga inabile al lavoro, l' INAMI ha determinato l' importo teorico senza fare riferimento all' ultima retribuzione del signor Reichling in Lussemburgo ma in base alla retribuzione minima stabilita da un contratto collettivo di lavoro belga.

In casu is het probleem, dat terwijl de invaliditeitsuitkering volgens de Belgische wet normaal gesproken is gebaseerd op het laatste loon van de aanvrager vóór hij arbeidsongeschikt wordt, het RIZIV het theoretische bedrag niet heeft berekend op basis van Reichlings laatste loon in Luxemburg, maar op basis van het bij een Belgische collectieve arbeidsovereenkomst vastgestelde minimumloon.

O problema suscitado neste caso é o de que, enquanto segundo a legislação belga a prestação de invalidez é normalmente baseada no último salário auferido pelo requerente antes de ficar incapacitado para o trabalho, o INAMI calculou o montante teórico por referência não ao último salário de André Reichling no Luxemburgo, mas com base no salário mínimo estabelecido por um acordo colectivo de trabalho belga.
