وعلى الرغم من استنتاج المحكمة الدستورية بشأن عدم دستورية الإجراء المتعلق بالقبول وجدول البنود، مثلما طبِّقا على صاحب البلاغ، لا تستطيع اللجنة أن تستنتج، بالاستناد إلى المواد المتاحة لها، أن المحكمتين الإداريتين قد تصرفتا، عند البت في قضية صاحب البلاغ، تصرفاً تعسفياً أو أن قرارهما ينطوي على خطأ واضح أو حرمان من العدالة.

Notwithstanding the Constitutional Court’s finding regarding the unconstitutionality of the Procedure for Admission and the Inventory Schedule, as applied to the author, the Committee is not in a position, on the basis of the materials at its disposal, to conclude that, in deciding the author’s case, the Administrative Courts acted arbitrarily or that their decision entailed a manifest error or denial of justice.

No obstante la constatación del Tribunal Constitucional en relación con la inconstitucionalidad de la aplicación al autor del Procedimiento de admisión y el Listado de elementos, el Comité no está en situación, sobre la base del material que tiene a su disposición, de determinar, a efectos de un dictamen sobre el caso del autor, que los tribunales administrativos actuaron de forma arbitraria ni que su dictamen comportara error manifiesto o denegación de justicia.

Несмотря на постановление Конституционного суда о неконституционности "Правил приема" и "Регламента" в применении к автору, Комитет не в состоянии на основе имеющихся в его распоряжении материалов заключить, что при вынесении решения по делу автора административные суды действовали произвольно или что их решения повлекли за собой очевидную ошибку или отказ в правосудии.
