The exemption applies for sub-sectors contained in Annex [X] in Parties: (1) with an average of at least two months per year over 10 consecutive years with a peak monthly average temperature above 35 degrees Celsius[footnoteRef:4]; and (2) that have formally notified use of this exemption by notifying the Secretariat no later than one year before the HFC freeze or other initial control obligation, and every 4 years thereafter should it wish to extend the exemption.

La exención se aplica a los subsectores incluidos en el anexo [X] en las Partes: 1) que tengan un valor medio de al menos dos meses al año durante 10 años consecutivos con una temperatura máxima media mensual superior a 35°C[footnoteRef:3]; y 2) que hayan comunicado oficialmente la utilización de esta exención notificando a la Secretaría a más tardar un año antes de la congelación de los HFC u otra obligación de control inicial, y en lo sucesivo cada 4 años si desease prorrogar la exención.

La dérogation vaut pour les sous-secteurs figurant à l’annexe [X] dans les parties 1) ayant connu pendant dix années consécutives deux mois au moins par an, en moyenne, des pics de température ambiante supérieurs à 35 °C[footnoteRef:4]1 et 2) ayant officiellement notifié au Secrétariat, au plus tard un an avant le gel des HFC ou toute autre obligation initiale, et par la suite tous les quatre ans, qu’elles souhaitent prolonger la dérogation.
