Regarding the allegations that the executive put pressure on the judiciary, in particular by transferring and/or removing the judges trying the case, namely the chief examining magistrate and the President of the Indictment Division, the State party reminds the Committee that the President of the Indictment Division is primus inter pares in a three-person court and is thus in no position to impose his or her views.

En cuanto a las afirmaciones de presión ejercidas por el poder ejecutivo sobre el poder judicial y, en particular, al hecho de que quienes se encargaban del asunto hubiesen sido reemplazados y/o trasladados, en este caso particular, el Decano de los jueces de instrucción y el Presidente de la Sala de Acusación, el Estado Parte recuerda que el Presidente de la Sala de Acusación es primus inter pares de un órgano jurisdiccional compuesto por tres miembros, o sea, sin la posibilidad de imponer su opinión.

Что касается утверждений об оказании давления со стороны исполнительной власти на судебную власть, и в частности того факта, что лица, участвовавшие в рассмотрении данного дела, были смещены со своих должностей и/или переведены на другую работу, в частности старейшина следственных судей и председатель обвинительной палаты, то государство-участник напоминает о том, что председатель обвинительной палаты является primus inter pares в рамках юридического образования в составе трех членов и поэтому не имеет возможности навязывать свое мнение.
