وتُضمن المحاكمة العلنية والعادلة بمقتضى المبدأ الذي يفيد بأن الإجراءات القضائية تتم على مرحلتين على الأقل (المادة 176 من الدستور)، وبموجب الحق في رفع شكاوى دستورية إلى المحكمة الدستورية بخصوص الامتثال لأحكام الدستور والنصوص القانونية الأخرى التي استعانت بها محكمة أو هيئة أخرى مماثلة في إصدار حكم نهائي بشأن الحريات والحقوق والالتزامات المنصوص عليها في الدستور.

A fair and public trial is guaranteed by the principle saying that court proceedings shall have at least two stages (Article 176 of the Constitution) and by the right to lodge constitutional complaints to the Constitutional Tribunal about the compliance with the provisions of the Constitution and other normative acts that have served the court or other authority to issue a final judgement on the freedoms, rights and obligations set out in the Constitution.

El juicio imparcial y público está garantizado por el principio en virtud del cual los procedimientos judiciales tendrán al menos dos etapas (artículo 176 de la Constitución) y por el derecho a presentar recursos ante el Tribunal Constitucional en relación con la conformidad con las disposiciones de la Constitución y otros instrumentos normativos en que se haya basado un tribunal u otra autoridad para emitir un dictamen definitivo sobre las libertades, los derechos y las obligaciones estipulados en la Constitución.

Le droit à un procès équitable et public est garanti par le principe du double degré de juridiction applicable à toute procédure (art. 176) et par le droit de contester devant le Tribunal constitutionnel la constitutionnalité des lois et autres textes normatifs sur lesquels un tribunal ou toute autre autorité s’est fondé pour prononcer un jugement en dernier ressort concernant les libertés, les droits et les devoirs énoncés dans la Constitution.
