وأوضح أن تلك الصيغة أكثر اتفاقا مع الصيغة المستخدمة في القانون النموذجي للتحكيم وأن الاستعاضة عن عبارة "the court" بكلمة "courts" في نهاية الجملة الأولى (من النص الإنكليزي، ولا ينطبق على النص العربي) يقصد بها التوضيح بأنه لا توجد نية للإشارة إلى إجراءات قضائية معيّنة، سواء كانت داخلية أم أجنبية
