وتُشدِّد اتفاقات عديدة على أهمية المجاملة القضائية لدى المحاكم واستقلالية المحاكم، مشيرة على وجه التحديد إلى أن هذه الاستقلالية لا ينبغي أن تتأثر سلبا أو يُنتقص منها من جراء الموافقة على الاتفاق العابر للحدود وتنفيذه.
