In its recommendations, the Working Group suggested the incorporation into the law of a categorical declaration that re-education through labour cannot be imposed on anyone for exercising his or her fundamental freedoms protected under the Universal Declaration of Human Rights, and to subject this measure to prior control by a judge, without thereby depriving it of its administrative character
