وتنص أحكام هذه المادة على ضرورة أن تكون سلطات الإفراج المشروط مقتنعة بأن هذا الإفراج مبرَّر بحجة أن الجاني معرّض لخطر الموت الوشيك أو في حالة عجز تشلّ قدرته البدنية على إيذاء الآخرين، وبحجة أنه أثبت أنه لا يشكّل خطراً على المجتمع.

Under this provision, the Parole Authority must be satisfied that this is justified on the grounds that the offender is in imminent danger of dying, or is incapacitated to the extent that he or she no longer has the physical ability to do harm to any person and has demonstrated that he or she does not pose a risk to the community.

En vertu de cette disposition, l’autorité de probation doit avoir la conviction qu’une libération conditionnelle se justifie parce que l’intéressé est en danger de mort imminent ou dans un état d’incapacité physique tel qu’il n’est plus en mesure de causer du tort à autrui et parce qu’il a démontré qu’il ne représentait plus aucun danger pour la communauté.
