In the interest of reducing the use of imprisonment and rationalizing criminal justice policy through greater community involvement and promoting the offender’s sense of responsibility towards society, he/she, in cases provided by law establishing criteria in respect of both the nature and gravity of the offence and his/her personality and background, the purposes of sentencing and the rights of victims, is eligible to be sentenced to a non-custodial sanction.

A fin de reducir el recurso al encarcelamiento y de racionalizar la política de justicia penal mediante una mayor participación de la comunidad y para promover el sentido de responsabilidad del delincuente para con la sociedad, en los casos previstos por la ley en que se fijen criterios relativos tanto al carácter como a la gravedad del delito y a la personalidad y antecedentes de su autor, la finalidad de la condena y los derechos de las víctimas, el delincuente podrá recibir sanciones no privativas de la libertad .
