Raadet har derimod i sit skriftlige indlaeg i det vaesentlige gjort gaeldende, at det endelige formaal med direktivet ikke var at sikre forsyningerne til den farmaceutiske industri, men at direktivet blot var et middel til at sikre beskyttelsen af sundheden gennem en tilstraekkelig produktion af laegemidler ( dvs . for at naa et maal, som ikke er omfattet af artikel 39 ); under den mundtlige forhandling har Raadet desuden fremhaevet, at det ved fastsaettelsen af bestemmelserne om forsyninger til den farmaceutiske industri skulle sikres, at den offentlige sundhed blev tilstraekkeligt beskyttet ( i hvilken forbindelse Traktatens artikel 100 kan komme i betragtning ).

The Council, on the other hand, contended in its pleadings essentially that assuring the availability of supplies to the pharmaceutical industry was not the ultimate objective of the directive, but only a means to ensure the protection of health through adequate production of pharmaceutical preparations ( that is to say, the attainment of an objective that is not included in Article 39 ); at the hearing the Council also emphasized that when rules were laid down on supplies for the pharmaceutical industry, it was necessary to ensure that public health was adequately protected ( in which respect Article 100 of the Treaty was relevant ) and it also expressed doubts whether, taking into account the lexical meaning and significance of the term in other Community measures, industrial undertakings could be regarded as consumers within the meaning of Article 39 .

A este respeito, por seu lado, o Conselho salientou essencialmente nas suas observações escritas que o abastecimento da indústria farmacêutica não constitui o objectivo final da regulamentação, mas apenas um meio, com vista a garantir a protecção da saúde, ao permitir uma produção suficiente de medicamentos (ou seja, com vista a um objectivo que não consta do artigo 39.°); por outro lado, durante a audiência, o Conselho sublinhou ter sido necessário, ao ser criada a regulamentação relativa ao abastecimento da indústria farmacêutica, considerar uma protecção adequada da saúde pública (domínio que poderia ser abrangido pelo artigo 100.° do Tratado) e expressou dúvidas quanto à questão de saber se, tendo em conta o sentido literal e o significado desta noção noutros actos comunitários, as empresas industriais podem ser consideradas consumidores, na acepção do artigo 39.
