وتذكّر اللجنة أنه، وفقاً للفقرة 4 من المادة 9 من العهد، فإن المراجعة القضائية لمشروعية الاحتجاز يجب أن تتيح إمكانية إصدار أمر بإطلاق سراح المحتجز إذا أُعلن أن احتجازه يتنافى مع أحكام العهد، ولا سيما أحكام الفقرة 1 من المادة 9 من العهد.

The Committee recalls that, in accordance with article 9, paragraph 4, judicial review of the lawfulness of detention must provide for the possibility of ordering the release of the detainee if his or her detention is declared incompatible with the provisions of the Covenant, in particular those of article 9, paragraph 1.

Комитет напоминает, что в соответствии с пунктом 4 статьи 9 при рассмотрении в суде вопроса о законности задержания должна предусматриваться возможность вынесения постановления об освобождении задержанного/задержанной, если его/ее задержание признается несовместимым с положениями Пакта, в частности с положениями пункта 1 статьи 9.
