In this light, it would be unconscionable for the Crown to insist on extinguishment of rights through the treaties because of factors that vitiated the free and informed consent of treaty nations.58 It is the Commission’s view that Canada should indicate its willingness to assume and implement the obligations of the Crown as these become apparent in light of the spirit and intent of the treaties.
