By application lodged at the Court Registry on 30 April 1999, the Commission of the European Communities brought an action for a declaration that, by maintaining unamended Article 257(1) of the French Customs Code of 11 May 1977 ('the Code‘) as regards Community shipowners covered by Article 1(1) of Council Regulation (EEC) No 3577/92 of 7 December 1992 (hereinafter 'the Regulation‘), the French Republic has failed to fulfil its obligations under that regulation.

Par requête déposée au greffe de la Cour le 30 avril 1999, la Commission des Communautés européennes a introduit un recours visant à faire constater que, en maintenant inchangé l'article 257, paragraphe 1, du code des douanes français du 11 mai 1977 (ci-après le «code») en ce qui concerne les armateurs communautaires couverts par l'article 1er, paragraphe 1, du règlement (CEE) n° 3577/92 du Conseil, du 7 décembre 1992 (ci-après le «règlement»), la République française a manqué aux obligations qui lui incombent en vertu dudit règlement.
