وقد أراد المقرر الخاص عند تعديل نص مشروع المادة أن يعالج التناقضات التي كانت موجودة بين النص الأصلي لمشروع المادة ("لا تنطبق مشاريع المواد هذه على الحالات التي تسري عليها قواعد القانون الدولي الإنساني") والتعليق ("ورغم أن مشاريع المواد لا تسعى لتنظيم نتائج النزاع المسلح، فإنها يمكن أن تسري في حالات النزاع المسلح التي لا تسري عليها قواعد القانون الدولي الحالية، ولا سيما قواعد القانون الدولي الإنساني").

By amending the draft article, the Special Rapporteur had no doubt intended to resolve the inconsistencies between the original wording of the article (“The present draft articles do not apply to situations to which the rules of international humanitarian law are applicable.”) and the relevant commentary (“[The present draft articles] can nonetheless apply in situations of armed conflict to the extent that existing rules of international law, particularly the rules of international humanitarian law, do not apply.”).

Al modificar el texto del proyecto de artículo, el Relator Especial ha querido sin duda solventar las incoherencias que existían entre la formulación original del artículo (“El presente proyecto de artículos no se aplicará a situaciones en que sean aplicables las normas del derecho internacional humanitario.”) y el correspondiente comentario (“[El presente proyecto de artículos] puede aplicarse no obstante a situaciones de conflicto armado en aquellos aspectos en que las normas vigentes del derecho internacional, y en particular las normas del derecho humanitario internacional, no sean aplicables.”)

En modifiant le texte du projet d’article, le Rapporteur spécial a sans doute voulu remédier aux incohérences qui existaient entre le libellé original de l’article (« Le présent projet d’articles ne s’applique pas aux situations auxquelles les règles du droit international humanitaire sont applicables. ») et le commentaire correspondant (« [Le présent projet d’articles] peut néanmoins s’appliquer dans des situations de conflit armé dans la mesure où les règles en vigueur du droit international, en particulier les règles du droit international humanitaire, ne s’appliquent pas. »).
