El retiro de la Convención por parte del presidente Evo Morales se produjo luego de que el Congreso Nacional de Bolivia lo votara, debido a que la nueva Constitución de este país, sancionada en 2009, daba un margen de cuatro años durante el cual el Gobierno “denunciará y, en tal caso, renegociará los tratados internacionales que puedan ser contrarios a la Constitución”.
