While the Supreme Court can issue the writ of habeas corpus only against the State in cases of violation of fundamental rights, the High Court can issue it also against private individuals illegally or arbitrarily detaining any other person.

हमारा संविधान जहां उच्चतम न्यायालय बंदी प्रत्यक्षीकरण की रिट को केवल मूल अधिकारों के उल्लंघन की दशा में राज्य के विरुद्ध जारी कर सकता है, वहां उच्च न्यायालय उसे उन व्यक्तियों के खिलाफ भी जारी कर सकता है जो अवैध या मनमाने ढंग से किसी अन्य व्यक्ति को निरुद्ध करते हैं।
