They note that this decision was appealed by the partie civile before the Second Prosecutor’s Office of the Military Higher Court which, through order of May 21, 2004, revoked the discontinuance of legal proceedings and initiated a trial against Captain Prieto Rivera and soldiers Luis Enrique Pineda Matallana and Orlando Evelio Ceballos Arboleda, for the murder of Wilfredo Quiñonez.

Señalan que esta resolución fue apelada por la parte civil ante la Fiscalía Segunda del Tribunal Superior Militar el cual, mediante providencia del 21 de mayo de 2004, revocó la cesación de procedimiento y llamó a juicio al Capitán Prieto Rivera y a los soldados Luis Enrique Pineda Matallana y Orlando Evelio Ceballos Arboleda, por el homicidio de Wilfredo Quiñónez.
