أمَّا فيما يخص المسألة الثانية، فقد رأت المحكمة، في ضوء وجود أدلة متضاربة بشأن استعداد المحكمة الحَبريّة للبت في القضية، أنها لا تجد أنَّ اتفاق التحكيم غير قادر على الوفاء بالغرض منه.

On the second issue, the court held that in presence of conflicting evidence regarding the Beth Din’s willingness to hear the case, it could not find the arbitration agreement to be incapable of performance.
