In an appeal brought before it, the Court of Justice observed that the general principle of Community law under which every person has a right to a fair trial, inspired by Article 6 of the European Convention for the Protection of Human Rights and Fundamental Freedoms, comprises the right to a tribunal that is independent of the executive in particular, but that it is not possible to deduce from that right or from the constitutional traditions common to the Member States that the court hearing a dispute is necessarily the only body empowered to grant access to the documents in the proceedings in question.
