ويوصي بتعديل الأحكام الدستورية التي تنص على أمور منها إنشاء محاكم عسكرية دائمة (المادة 293(ب)) خارج إشراف آليات العدالة المدنية، وتمنح القائد العام حق الطعن في قراراتها (المادة 343(ب))؛ وتنص على عدم اتخاذ أي إجراء قضائي ضد أي عضو من الحكومة فيما يتصل بأي فعل قام به خلال أداء واجباته (المادة 445)، كما تمنح الحصانة الفعلية للعسكريين من الملاحقة بسبب انتهاكات حقوق الإنسان التي قد يرتكبونها؛ وتمنح العسكريين المعيَّنين 25 في المائة من مقاعد البرلمان (المواد 74، 109(ب) و141(ب))، وتمنح العسكريين فعلاً الحق في نقض التعديلات الدستورية.

He recommends the amendment of constitutional provisions which, inter alia, provide for the establishment of permanent military tribunals (article 293 (b)), separate from oversight of the civilian justice mechanisms, for which the Commander-in-Chief exercises appellate power (article 343 (b)); stipulate that no proceeding shall be brought against any member of the Government in respect of any act done in the execution of their duties (article 445), effectively providing the military with immunity for human rights violations that may have been committed; and allow for military appointees to occupy 25 per cent of seats in Parliament (articles 74, 109 (b), 141 (b)), which also effectively provides the military with a veto on Constitutional amendments.

Recomienda la modificación de las disposiciones constitucionales que, entre otras cosas, prevén el establecimiento de tribunales militares permanentes (art. 293 b)), exentos de la supervisión de los mecanismos de justicia civil, en los cuales el Comandante en Jefe tiene competencia en apelación (art. 343 b)); estipulan que no se iniciará proceso judicial alguno contra un integrante del Gobierno respecto de cualquier acto cometido en el cumplimiento de sus obligaciones (art. 445), lo cual de hecho garantiza la inmunidad a los militares por las violaciones de derechos humanos que pueden haber cometido; y permiten que los militares designados ocupen el 25% de los escaños en el Parlamento (arts. 74, 109 b), 141 b)), lo cual otorga efectivamente a los militares un derecho de veto en las enmiendas constitucionales.
