Während nämlich in Artikel 27 davon die Rede ist, daß "certain types of tax evasion or avoidance" verhütet werden sollen, spricht die siebzehnte Begründungserwägung von dem Ziel, "to avoid fraud or tax avoidance", und fügt diesem letztgenannten Begriff ( der der "evasão fiscal" im Portugiesischen und gleichbedeutenden Ausdrücken in den übrigen romanischen Sprachen entspricht ) den Begriff "fraud" hinzu, der als einziger in der Zweiten Richtlinie genannt war .

Whilst the wording of Article 27 refers to the prevention of "certain types of tax evasion or avoidance", the objective referred to in the seventeenth recital in the preamble to the directive is "to avoid fraud or tax avoidance", thereby adding the latter concept ( which corresponds to "evasão fiscal" in Portuguese and to like terms in other Romance languages ) to that of "fraud", which was the only one referred to in the Second Directive .
