Als Antwort auf diese Stellungnahme teilte die italienische Regierung mit Schreiben der Ständigen Vertretung Italiens vom 15 . Juli 1986 mit, das Verfahren zur Verabschiedung des genannten Gesetzentwurfs sei blockiert worden, da der Ministerrat am 23 . Mai 1986 den Entwurf eines Gesetzes gebilligt und an das italienische Parlament weitergeleitet habe, dessen Artikel 24 eine Ermächtigung an die Regierung enthalte, ein Dekret mit Gesetzeskraft zu erlassen, das einen Testo Unico zur Umstrukturierung der gesamten geltenden italienischen Rechtsvorschriften über den Gewässerschutz und die Abfallbeseitigung unter Berücksichtigung der einschlägigen Gemeinschaftsrichtlinien enthalte .

Η ιταλική κυβέρνηση, απαντώντας στην αιτιολογημένη αυτή γνώμη, δήλωσε με έγγραφο της 15ης Ιουλίου 1986 της μόνιμης αντιπροσωπείας της Ιταλίας ότι η διαδικασία ψήφισης του προαναφερθέντος νομοσχεδίου είχε διακοπεί, επειδή το υπουργικό συμβούλιο ενέκρινε και διαβίβασε στις 23 Μαΐου 1986 στην ιταλική Βουλή νομοσχέδιο, το άρθρο 24 του οποίου περιελάμβανε μεταβίβαση αρμοδιοτήτων στην κυβέρνηση προκειμένου να θεσπίσει διάταγμα νομοθετικής ισχύος που να περιέχει ενιαίο κείμενο με σκοπό την αναμόρφωση - λαμβανομένων υπόψη των σχετικών κοινοτικών οδηγιών - όλης της ισχύουσας ιταλικής νομοθεσίας για την προστασία των υδάτων από τη ρύπανση και την εξάλειψη των αποβλήτων.

In response to that reasoned opinion, the Italian Government stated in a letter dated 15 July 1986 from the Italian Permanent Representation that the procedure for the enactment of the draft law had been suspended and that the Government had approved and transmitted to the Italian Parliament on 23 May 1986 a draft law, Article 24 of which delegated to the Government the authority to adopt, by decree, a consolidated text intended to restructure, with due regard to relevant Community directives, the whole of the Italian legislation in force relating to the protection of waters against pollution and the disposal of waste .

En respuesta a este dictamen motivado, el Gobierno italiano indicó, mediante carta de la representación permanente de Italia de 15 de julio de 1986, que el procedimiento para la adopción del proyecto de ley antes mencionado había quedado bloqueado, puesto que el Consejo de Ministros había aprobado y remitido al Parlamento italiano, el 23 de mayo de 1986, un proyecto de ley cuyo artículo 24 contenía una delegación de competencias al Gobierno para que éste promulgara un decreto con fuerza de ley conteniendo un texto único destinado a reorganizar, teniendo en cuenta las directivas comunitarias en la materia, toda la legislación italiana en vigor sobre la protección de aguas contra la contaminación y sobre la eliminación de residuos.

In risposta a detto parere motivato il governo italiano osservava, con lettera della rappresentanza permanente dell' Italia 15 luglio 1986, che l' iter del suddetto disegno di legge era stato bloccato, giacché il Consiglio dei ministri aveva approvato e trasmesso al Parlamento italiano, il 23 maggio 1986, un disegno di legge che, nell' art . 24, autorizzava il governo ad emanare, con decreto avente forza di legge, un testo unico inteso a riordinare, tenendo conto delle direttive comunitarie in materia, l' intera normativa italiana vigente sulla tutela delle acque contro l' inquinamento e sullo smaltimento dei rifiuti .

In antwoord hierop verklaarde de Italiaanse regering in een brief van de Italiaanse Permanente Vertegenwoordiging van 15 juli 1986, dat de procedure tot vaststelling van dit wetsontwerp was stopgezet, omdat de ministerraad op 23 mei 1986 een wetsontwerp had goedgekeurd en bij het Parlement had ingediend . In artikel 24 van dat wetsontwerp werd aan de regering de bevoegdheid gedelegeerd om een wetsbesluit houdende een Testo unico vast te stellen, die de gehele vigerende Italiaanse wetgevingen betreffende de bescherming van wateren tegen verontreiniging en de verwijdering van afvalstoffen zou moeten reorganiseren, rekening houdende met de ter zake geldende communautaire richtlijnen .

Em resposta a este parecer fundamentado, o Governo italiano indicou, por carta da representação permanente da Itália de 15 de Julho de 1986, que o processo de aprovação do projecto de lei citado estava bloqueado, tendo o Conselho de Ministros aprovado e enviado ao parlamento italiano, em 23 de Maio de 1986, um projecto de lei cujo artigo 24.° continha uma delegação de poderes ao governo para adopção de um decreto com força de lei que conteria um texto único destinado a reorganizar, tendo em conta as directivas comunitárias na matéria, toda a legislação italiana em vigor sobre a protecção das águas contra a poluição e sobre a eliminação dos dejectos.
