ثم إن التنصيص على الحقوق الاقتصادية والاجتماعية والثقافية في الدستور، بوصفها أهدافاً اجتماعية بدلاً من كونها حقوقاً وحريات، يساهم في إضعافها ويضعها في فئة ثانوية.
