وفيما يتعلق بتوصية المقرر الخاص بأن يكون معهد الطب الشرعي مستقلاً عن أي سلطة تكون مسؤولة عن التحقيق أو المقاضاة في الجرائم، ذكرت الحكومة أن جميع هيئات التحقيق الجنائي بما فيها المعهد المذكور والوحدة الفنية للشرطة القضائية ستخضع لسلطة مكتب النائب العام، وذلك بعد أن تطبق المدونة الجديدة لقانون الاجراءات الجنائية الإجراء المتعادل الجديد على الرغم من أن هاتين الهيئتين ستظلان من الناحية الإدارية تابعتين لوزارة العدل

Concerning the Rapporteur's recommendation that the Institute of Forensic Medicine should be independent of any authority responsible for the investigation or prosecution of crime, the Government stated that, following the introduction of the new accusatorial procedure by the CCP, all criminal investigation bodies, including that Institute and the Judicial Police Technical Unit, would be under the authority of the Public Prosecutor's Office, although administratively they would continue to be attached to the Ministry of Justice

Sobre la recomendación del Relator en orden a que el Instituto de Medicina Legal fuese independiente de las autoridades encargadas de la investigación o enjuiciamiento, el Gobierno señaló que, tras la introducción por el COPP del nuevo sistema acusatorio, todos los órganos de investigación penal, entre ellos el Instituto de Medicina Legal y el Cuerpo Técnico de Policía Judicial, pasaron a depender del ministerio público, aunque desde el punto de vista administrativo seguirán bajo el Ministerio de Justicia

Au sujet de la recommandation du Rapporteur spécial selon laquelle l'Institut médico-légal devait être indépendant de toute autorité responsable de l'enquête ou chargée des poursuites pénales, le Gouvernement a signalé qu'après l'adoption du nouveau système accusatoire prévu par le COPP tous les organes chargés d'enquêtes pénales, notamment l'Institut médico-légal et le corps technique de la police judiciaire, relèveraient du ministère public, même si, sur le plan administratif, ils continuent de dépendre du Ministère de la justice

По поводу рекомендаций Докладчика вывести Институт судебной медицины из подчинения любым органам, ответственным за расследование преступлений или за уголовное преследование правонарушителей, правительство сообщило, что с принятием в соответствии с ОУПК новой обвинительной системы все уголовно-следственные органы, в частности экспертно-криминалистическое управление судебной полиции, перейдут в систему прокуратуры, хотя и останутся в административном подчинении министерства юстиции
