uložit žalované, aby žalobkyni uhradila náhradu škody za nemajetkovou újmu utrpěnou v letech 2008 — 2011 z důvodů výše uvedených nesrovnalostí; Náhrada škody bude stanovena měsíčně a bude odpovídat rozdílu v platu mezi žalobkyní a místním zaměstnancem za období let 2008 — 2011, a to z důvodu, že zastoupení: a) úmyslně přidělovalo žalobkyni totožné pracovní úkoly, jaké přidělovalo místnímu zaměstnanci, navzdory rozdílům v jejich pracovních náplních; b) činilo vše, aby žalobkyně nemohla řádně plnit úkoly a zastávat pozici skutečně odpovídající její pracovní náplni; c) stále odmítalo, že pracovní místo žalobkyně zahrnovalo rovněž zastupování vedoucího FCA;

Order the Defendant to pay of damages for the moral prejudice caused from 2008 until 2011 by the irregularities mentioned above. Damages are to be calculated on a monthly basis as the salary difference between the Applicant and the Local Agent for the entire 2008-2011 period -the reasoning being that the Delegation (a) had willingly assigned to the Applicant identical tasks as given to the Local Agent despite of very different Job Descriptions, (b) had done its utmost to keep the Applicant from performing tasks/undertaking the correct position according to the Job Description, (c) constantly denied that Applicant's post involved deputing to the Head of the FCA.

de verwerende partij veroordelen tot een vergoeding voor de immateriële schade die zij van 2008 tot 2011 heeft geleden als gevolg van de bovengenoemde onregelmatigheden, welke op maandelijkse basis moet worden vastgesteld en bestaat in het verschil tussen verzoeksters salaris en dat van een plaatselijk functionaris voor de gehele periode van 2008 tot 2011, en wel omdat de delegatie: a) verzoekster willens en wetens dezelfde taken heeft opgedragen als die welke aan de plaatselijk functionaris waren opgedragen, en dit ondanks hun verschillende werkomschrijvingen; b) alles heeft gedaan om te verhinderen dat verzoekster haar taken kon vervullen en werkzaamheden kon uitoefenen die daadwerkelijk overeenkwamen met haar werkomschrijving; c) steeds heeft ontkend dat haar post eveneens inhield dat zij optrad als waarnemer van het hoofd van de afdeling FCA;

uložiť žalovanej, aby žalobkyni nahradila nemajetkovú ujmu, ktorá jej bola spôsobená v rokoch 2008 — 2011 z dôvodu vyššie uvedených nezrovnalostí, pričom jej výška sa určí na mesačnom základe a bude zodpovedať platovému rozdielu medzi žalobkyňou a miestnym zamestnancom v období rokov 2008 — 2011, a to z dôvodu, že zastúpenie: a) úmyselne prideľovalo žalobkyni rovnaké pracovné úlohy, aké prideľovalo miestnemu zamestnancovi, napriek rozdielom v ich pracovných náplniach; b) robilo všetko pre to, aby žalobkyňa nemohla riadne plniť úlohy a zastávať pozíciu skutočne zodpovedajúcu jej pracovnej náplni; c) stále popieralo fakt, že by pracovné miesto žalobkyne zahŕňalo aj zastupovanie vedúceho FCA,
