2 Those questions were raised in proceedings for judicial review brought by Monsanto plc (Monsanto), seeking a declaration that the Minister for Agriculture, Fisheries and Food and the Secretary of State for the Environment (the ministers) were failing to comply with Articles 4(1)(b) to (f) and 8(2) and (3) of Directive 91/414.
