ويوصي بيان اللجنة بأن تأخذ هيئة التحكيم بعين الاعتبار، لدى ممارسة صلاحيتها التقديرية، عدّة عوامل تساعدها على تقرير ما إذا كانت المذكّرة مفيدة لها، ومن هذه العوامل ما إذا كانت لدى صديق الهيئة معرفة أو بصيرة مختلفة عمّا لدى الطرفين، وما إذا كانت المنازعة المعنيّة تهمّ صديق الهيئة وعامة الناس.

The Statement recommends that in exercising its discretion, the Tribunal should consider a number of factors designed to help it determine whether or not the amicus submission will be helpful to the Tribunal—these include whether the amicus has knowledge or insight different from the parties and whether there is both an interest of the amicus and of the public in the dispute.

En la Declaración se recomienda, que, al ejercer su discreción, el tribunal tenga en cuenta una serie de factores que lo ayuden a determinar si la presentación del tercero será de utilidad para el tribunal; concretamente, deberá estudiar si el tercero puede aportar conocimientos o consideraciones distintas de las de las partes y si la controversia afecta tanto al tercero como al público en general.

La Déclaration recommande que, dans l’exercice de son pouvoir discrétionnaire, le tribunal examine un certain nombre de facteurs destinés à l’aider à déterminer si oui ou non le mémoire présenté par un amicus curiae lui sera utile, notamment si l’amicus curiae a des connaissances ou des idées particulières qui sont différentes de celles des parties contestantes, si l’arbitrage présente un intérêt pour l’amicus curiae et si la question soumise à l’arbitrage est d’intérêt public.
