”إذا لم تحدد هذه المفاوضات [المشار إليها أعلاه] إبرام الاتفاق المشار إليه أعلاه [بشأن تعيين حدود الجرف القاري والمنطقتين الاقتصاديتين الخالصتين في البحر الأسود] في وقت زمني معقول، لا يتجاوز سنتين من تاريخ البدء فيها، تتفق حكومة رومانيا وحكومة أوكرانيا على أن تحل محكمة العدل الدولية التابعة للأمم المتحدة مشكلة تعيين حدود الجرف القاري والمنطقتين الاقتصاديتين الخالصتين، بناء على طلب أي من الطرفين، شريطة دخول المعاهدة المتعلقة بنظام حدود الدولة بين رومانيا وأوكرانيا حيز النفاذ.

“If these negotiations [referred to above] shall not determine the conclusion of the above‐mentioned agreement [on the delimitation of the continental shelf and the exclusive economic zones in the Black Sea] in a reasonable period of time, but not later than 2 years since their initiation, the Government of Romania and the Government of Ukraine have agreed that the problem of delimitation of the continental shelf and the exclusive economic zones shall be solved by the UN International Court of Justice, at the request of any of the parties, provided that the Treaty on the regime of the State border between Romania and Ukraine has entered into force.

“Si estas negociaciones [a las que se ha hecho referencia más arriba] no desembocaran en la celebración del acuerdo mencionado más arriba [sobre la delimitación de la plataforma continental y las zonas económicas exclusivas en el Mar Negro] en un plazo razonable, pero no superior a dos años desde su comienzo, el Gobierno de Rumania y el Gobierno de Ucrania han convenido en que el problema de la delimitación de la plataforma continental y las zonas económicas exclusivas deberá ser resuelto por la Corte Internacional de Justicia de las Naciones Unidas, a petición de cualquiera de las partes, siempre que el Tratado sobre el Régimen Fronterizo entre Rumania y Ucrania haya entrado en vigor.

«Правительство Румынии и правительство Украины договариваются, что, если эти переговоры [упомянутые выше] не приведут к заключению вышеупомянутого соглашения [о делимитации континентального шельфа и исключительных экономических зон в Черном море] в разумный период времени, но не позднее чем через два года после их начала, проблема делимитации континентального шельфа и исключительных экономических зон будет разрешена Международным Судом Организации Объединенных Наций по просьбе любой из сторон, при том условии, что Договор о режиме государственной границы между Румынией и Украиной вступит в силу.
