(২) এই আইনের দায়েরকৃত কোন মামলায় আদালত শুনানী ও বিচারান্তে যদি কোন অভিযুক্ত ব্যক্তিকে খালাস প্রদান করে এবং আদালত তার রায়ে সুস্পষ্টভাবে উল্লেখ করেন যে, উক্ত অভিযুক্ত ব্যক্তির বিরুদ্ধে আনীত অভিযোগ মিথ্যা, ভিত্তিহীন ও হয়রানিমূলক, তা হলে মামলা দায়েরকারী ব্যক্তি অপরাধ করেছেন বলে গণ্য হবেন এবং উক্তরূপ অপরাধের জন্য তিনি সর্বোচ্চ ১ (এক) বছর পর্যন্ত কারাদন্ড অথবা সর্বোচ্চ ১ (এক) লক্ষ টাকা পর্যন্ত অর্থদন্ড অথবা উভয় দন্ডে দন্ডিত হবেন।

If the accused is acquitted by a court at the end of hearing and trial of any case filed under this Act and the court mentions it clearly in the judgement that the complaints brought against the accused is false, groundless and harassing, the complainant shall be deemed to have committed an offence and for such offence, be punished with imprisonment for a term not exceeding 1 (one) year or with a fine of Taka not exceeding 1 (one) lac or with both.
