The same penalties shall apply to any person who owns, rents, administers or possesses, in any capacity whatsoever, a commercial establishment, cinema, hotel, restaurant, bar, centre for dancing or music, sports area, educational establishment of any level or other establishment of a similar nature open to the public, and who habitually tolerates or permits trafficking in or consumption of any of the substances mentioned in article 1, if he cannot but know of the occurrence of these acts.

Las mismas penas se aplicarán al propietario, arrendatario, administrador o tenedor, a cualquier título, de un establecimiento de comercio, cine, hotel, restaurante, bar, centro de baile y música, recinto deportivo, establecimiento educacional de cualquier nivel, u otro de similar naturaleza abierto al público, que permita o tolere habitualmente el tráfico o consumo de alguna de las substancias mencionadas en el Artículo 1°, no pudiendo menos que conocer la ocurrencia de tales hechos.
