The Commissioner argued, in his submission dated August 8, 2003, that Agripack had not met the criterion that it was "unable to act or to give a mandate" since none of the actions presented by Agripack constituted circumstances beyond its control, nor did they interfere with its capacity to file a dispute notice under section 60 of the Act or give a mandate to file such a dispute notice within the legislative time limit.

Le commissaire a soutenu, dans son exposé du 8 août 2003, qu'Agripack n'avait pas satisfait au critère « n'a pu ni agir ni mandater quelqu'un pour agir » puisque aucune des mesures présentées par Agripack ne constituait des circonstances indépendantes de sa volonté, ou n'entravait sa capacité de déposer un avis de contestation aux termes de l'article 60 de la Loi ou de mandater quelqu'un pour déposer un tel avis dans le délai prévu par la loi.
